By creating a TipBux account, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service. Your use of the TipBux platform constitutes your acceptance of these Terms of Service. If you do not agree to these Terms of Service, please do not use the TipBux platform.

TipBux Overview:

TipBux is a mobile tipping app that allows users to send and receive tips nationwide. By using TipBux, you agree to be bound by these terms of service. 

• Eligibility:
  • To use TipBux, you must be at least 16 years old and have a valid bank account. You must also agree to provide accurate and up-to-date information when creating your TipBux account.
• Account Security:
  • You are responsible for the security of your TipBux account and password. Do not share your password with anyone. If you believe your account has been compromised, contact TipBux immediately.
• Use of TipBux:
  • Use TipBux to send and receive tips. Do not use TipBux for any illegal or unauthorized purpose. Do not send or receive discriminatory, harassing, or offensive tips.

TipBux: Terms of Service - Finality of Tips

1. Finality of Tips

All tips sent through TipBux are final. By confirming a tip, you acknowledge and agree that:

• You have reviewed the recipient's profile picture and tip amount displayed on the confirmation page before finalizing the transaction.
• You are solely responsible for ensuring you are sending the tip to the correct recipient and for the chosen amount.
• TipBux cannot be held liable for any errors made during the tipping process, including sending a tip to the wrong user or for an incorrect amount.

2. Reporting Issues

If you believe you have made a mistake while sending a tip, you can contact TipBux support. We will do our best to assist you, however, we cannot guarantee a resolution for cases of non-technical errors.

3. Proof of Technical Errors

For TipBux to investigate a potential technical error, you may be required to provide evidence demonstrating the issue was not caused by human error. This evidence may include screenshots, error messages, or transaction details.

4. Limitation of Liability

TipBux is not responsible for any damages or losses incurred due to user error during the tipping process. This includes, but is not limited to, sending a tip to the wrong user or for an incorrect amount.

5. TipBux Platform Purpose

TipBux is a digital platform designed to facilitate peer-to-peer monetary transactions, primarily for the purpose of tipping individuals for services rendered. TipBux does not serve as a marketplace or intermediary for the exchange of goods or services.

6. User Conduct

Users acknowledge and agree that TipBux is not responsible for the fulfillment of any agreements or transactions entered into between users. Any arrangements for the exchange of goods or services outside of the core tipping functionality are solely between the involved parties. TipBux assumes no liability for any disputes, losses, or damages arising from such arrangements.

7. Transaction Nature

All transactions on the TipBux platform are considered to be tips unless explicitly stated otherwise by the sender in the transaction message. While users may specify the purpose of a transaction (e.g., payment for a service), TipBux does not guarantee the delivery or quality of any goods or services associated with such transactions.

8. Disclaimer

TipBux encourages users to exercise caution and good judgment when engaging in transactions that involve the exchange of goods or services. Users should verify the identity and reliability of the other 

party involved in any such transaction before proceeding.

9. Failed Payments, Insufficient Funds (NSF) Fees, and Account Suspension

9.1 Failed Payment Penalty

You acknowledge and agree that when you initiate a deposit of funds into your TipBux Wallet via bank transfer (including ACH), and that transfer is rejected or returned to TipBux for any reason, including but not limited to Insufficient Funds (NSF), an invalid account number, or a stop payment order, you will be liable for any associated fees and costs incurred by the TipBux platform.

You specifically agree that a Stripe penalty fee of $4.00 will be assessed and immediately deducted from your TipBux Wallet balance for each failed transfer attempt.

• Deduction from Wallet: The $4.00 penalty fee will be immediately deducted from your available TipBux Wallet balance.
• Negative Balance: If your TipBux Wallet balance is zero or insufficient to cover the penalty fee, your Wallet balance will become negative. You authorize TipBux to recover the outstanding negative balance from any future successful deposits or earnings that are credited to your TipBux Wallet.
• Suspension: You agree that TipBux reserves the right to immediately suspend or permanently terminate your account and your access to the Service if your account incurs multiple failed transfer fees or maintains a negative balance for more than 7-30 business days.

You understand that the financial institution that holds your bank account may also assess its own Insufficient Funds (NSF) fee or other charges against your bank account as a result of the failed transfer. TipBux is not responsible for any fees assessed by your own bank.

TipBux reserves the right to suspend or terminate your account if you are unable to remedy the negative balance resulting from failed transactions within the time period specified in Section 9.2.

Security Measures:

• Please note that TipBux utilizes Stripe, a trusted payment processor, to ensure the security and authenticity of user accounts. Stripe employs robust security measures to protect your financial information.

Continued Improvements:

• We are constantly evaluating our fee structure to ensure fairness and transparency for both tippers and creators.
• Ownership of Content:
  • You own the content you create and post on TipBux. By posting content on TipBux, you grant TipBux a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, and modify your content.
• Indemnification:
  • You agree to indemnify and hold TipBux harmless from any claims, losses, damages, liabilities, costs, and expenses arising out of or in connection with your use of TipBux.
• Termination:
  • TipBux may terminate your account at any time for any reason. You may also terminate your account at any time.
• Governing Law:
  • These terms are governed by the laws of the State of California. Disputes will be resolved in the courts of the State of California.
• Entire Agreement:
  • These terms constitute the entire agreement between you and TipBux, superseding all prior or contemporaneous communications, representations, or agreements, whether oral or written.
• Severability:
  • If any provision is found to be invalid or unenforceable, it will be struck, and the remaining provisions will remain in full force and effect.
• Waiver:
  • No waiver of any provision will be effective unless in writing and signed by both parties.
